President Barack Obama put Immigration issues in his legislative agenda for 2013. But in the immigration reform discourse shifted to Tax immigrants battle cry spearheaded by Republicans. As a result more of tax-related bugaboos are surfacing as people are guessing whether undocumented immigrants have to pay taxes to states or the federal government.
Now the Hametian question repeats-To be or not to be.
Meanwhile the Institute on Taxation and Economic Policy (ITEP) worked into the issue to assess the hard truth whether undocumented families really pay taxes. According to ITEP, the illegal immigrants paid the same regressive taxes that affect low-income families at the state and local level. In fact, nationwide the undocumented families paid $11 billion in state and local taxes in 2010.
Sales and excise taxes are a problem for low-income taxpayers who do not depend on citizenship status for any goodies. Every time a a cup of coffee, or a pair of jeans is purchased or you fill up gas, local sales and excise taxes are paid by all.
The renters among them pay property taxes indirectly because landlords pass their property tax bills to their tenants in the form of higher rents. Some undocumented taxpayers have state income taxes withheld from their pay checks each year. Even if there were 47 percent of the population paying no taxes, undocumented immigrants would not be part of that.

But some see the proposal of unpaid taxes collection from illegal immigrants as a gimmick to win over Republican as a pathway to citizenship for 11 million people.
The sharp amendment authored by Senator Orrin Hatch require illegal immigrants to pay back taxes before applying for citizenship. But critics frown the amendment saying it will scupper the bill. The Tax immigrants is unrealistic as an illegal immigrant who had been working in an underground economy cannot calculate unpaid taxes and shell out huge amounts to the government.

As a major reform and a benign gesture of accommodation, aliens living in the US without proper documentation and entered in the country before 31, December 2011 will get relief and can apply for the newly created immigration status called Registered Provisional Immigrant (RPI). The process of application requires paying a $500 fine and some fees. The RPI status will allow a migrant authorization to work and change jobs and travel outside the United States.
Obama immigration reform details stipulate that after 10 years, a person with an RPI status but regularly employed can apply for a green card and attain citizenship in three years. In the meantime the applicants must show proficiency in English and pass a criminal background check.
Persons convicted of an aggravated felony and misdemeanours or voting fraud will not be eligible. The current day youngsters who came to the country at a young age and raised in the United States, will have a shorter path to citizenship under the new legislation. They can apply for RPI status and wait for five years to apply for a green card. Under Obama Immigration Reform waiver the time spent in RPI status will be counted for naturalization and help DREAMers to become citizens immediately upon receiving their green cards. Obama Immigration Reform waiver also helps immigrant workers to be covered by US labour laws to get minimum wage, workplace protection, non-discrimination and other labour rights.
One of purposes of the immigration and naturalization service is for prevention of illegal entrants into the United States of America. This service works in association with law of Naturalization. This term is used to give proper authentication to foreign born citizens of one country, and preparing them to be a citizen of another country. There is a set of procedures for the naturalization of a foreign born person in place. In a nutshell, this service prevents the illegal dwellers from illegally receiving benefits such as social security, healthcare services, education and employment.
Structure of this form of service
The INS is headed by a commissioner appointed by the president. The president must report the appointment to the attorney general in the department of justice. The INS works together with the United Nations health and Human Services and the State Department. It had four main divisions. These are Management, Policy and Planning, Field Operations, and Programs.
The programs and the field operations divisions include the operational functions of the INS. The enforcement of national policy including examinations, deportation and detaining of illegal migrants are performed by the program division. Those who are illegally living in the United States get investigated, and if determined to be illegally in country they are detained and deported by means of the Immigration and Naturalization Services. The control of legal and illegal entry is also performed by the program division.
Prerequisites of opting for this facility
There are certain procedures, immigrants face while going through this type of service. There is no alternative to following the law and rules that are in place. In this process, overseeing the many INS offices working throughout the country and the world is done by the Field Operations division. The field operations division oversees 33 districts and 21 border areas. It had three regional offices. Outside the country, there are 16 offices which are overseen by the international headquarters. The field operations division is responsible for the administration of the international headquarters. Thus international tasks are performed under the auspices of the field operations division.
The policy and planning and the managerial functions are included in the Management division. The office of policy and planning communicates with the public and other cooperating government agencies. The office of policy and planning also coordinates information for the INS.
The office was again divided into three sub divisions – the Evaluation and Research Center, Planning division and the Policy division. The Management division maintains the overall mission of the Immigration and Naturalization Service throughout its many offices and provides administrative services to these offices. These duties are managed by the offices of Equal Employment Opportunity, Human Resources and Administration, Finance and Information Resources Management.
